These General Terms of Sale regulate the contractual relationships regarding purchases of goods and services on the website www.nauticacentis.it.

Recipients

The Customers of the website are natural persons of at least 18 years of age who act for purposes outside any business, commercial, professional or craft activity they may carry out.

Registration and personal page

The customer guarantees that the personal data provided during the registration procedure to the Website are accurate.
The customer undertakes to timely notify any change in such data and to verify that the email address indicated when signing in is still working properly. The login credentials to access the customer’s personal page of the website are personal and may not be assigned to any third party.

Conclusion of the agreement

By sending an Order online, a Customer makes a firm offer to buy the products selected in the Cart, with express request of performance even without a prior acceptance. 
The seller has the right to accept or not accept the offer, or to accept it in part, for less than the quantity indicated, by giving notice of the above within 30 days of the date of transmission of the Order, even to the email address indicated during the registration process.

Availability and products

The availability of the products is generally indicated on the website and updated as often as possible. 
The parties consider this update period sufficient to ensure reliable information, but it is not possible to exclude that a product indicated as available at the time of the Order may not be actually assigned to that Order.

Informations needed for the conclusion of a contract

Under Legislative Decree 70 of 9 April 2003, we inform our Customers that in order to make their purchase offer, they will have to follow the cart procedure.
Such procedure permits – before actually transmitting the order form – to detect and correct any error made when entering the data. At the end of this procedure, the supplier will contact the customer in order to finalize the sale.
Once the purchase offer has been sent, the supplier, immediately after accepting the order, will send via email the General Terms of Sale and the "Order Registration Confirmation" (with a summary of the features of the product purchased, a detailed indication of the price and of the payment method used, of the delivery costs and of any additional costs. For consumers, information regarding the right of withdrawal will also be provided).

Prices and payments

The prices published on the Website are stated in Euro and inclusive of VAT.
The Products purchased may be paid by the methods described in the website, in the cart procedure in English language.
The types of credit cards accepted by the supplier will be specifically indicated in the page regarding payment methods.
In case of withdrawal or early termination of the agreement for any reason requiring the amount paid by credit card to be reaccredited, the supplier will ask the customer for their bank details in order to carry out the bank transfer refund.

Costs and terms of delivery

Products are shipped to Customers in the Italian territory (unless agreed otherwise in writing) at the ground floor of the building, at the address indicated during the purchase procedure and using a carrier chosen among those indicated in the website.
On receiving the goods, the customer must verify the integrity of the parcels and the conformity, in terms of quantity, with the indications contained in the accompanying document and in the “Order Confirmation” email.
In any case of irregularities, the Customer must report them on the copy of the transport document that remains with the Carrier and confirm them by a registered letter a.r. (with acknowledgment of receipt) or e-mail to the address [email protected] within 3 working days of receiving the goods.

Right of withdrawal

A customer who is a consumer, namely an individual who makes a purchase without giving any reference of VAT number, is entitled to withdraw from the contract of purchase of the products without any penalty and without specifying the reason, within a period of ten working days since receiving the products, except where customisation of any kind has been implemented or except where the goods have been commissioned specifically for the customer. Saturdays are considered as holidays. If the above period expires on a holiday, it is extended to the first working day thereafter.
A customer who intends to exercise the right of withdrawal must notify the supplier thereof by an express declaration, which may be transmitted by a registered letter a.r. or by e-mail to the address [email protected].
In case of exercise of the right of withdrawal, the customer has the duty to return the goods within 10 days from the date on which the customer notified his (or her) intent to withdraw from the contract under art. 64, D.lgs 206/2005. The goods must be reshipped to Nautica Centis S.r.l., P.ta dell'Imbarcadero 19, 33053 Latisana - Fraz. Aprilia Marittima (UD) - Italy. The goods must be returned intact, in their original pack, complete in all parts (including packaging and any documents and accessories); products that have been used, damaged or that got dirty will not be accepted. The returning costs and any other cost (custom duties, taxes and duties, etc.) have to be supported by the customer.
Except for the right to verify the compliance with the above requirements, the supplier will provide the refund of the amount of the products involved in the withdrawal within the time limits under law by reversal of the transaction by bank transfer within 30 days. The customer must provide the supplier with his bank details.
The refund does not include the costs of delivery from the supplier to the client. The return shipment, until receipt at our warehouse, is under the complete responsability of the customer.
Nautica Centis S.r.l. is not responsible in any way for damage and/ or theft/loss of returned goods. The return of products which are non intact, used, damaged or deprived of the original accessories will not be accepted and will be given back to the sender, with the charge of the shipping costs and consequent cancellation of the withdrawal request.

Complaints

Complaints must be addressed to Nautica Centis srl or through the Website by accessing the "Online Customer Assistance Service" section.

Governing law

All purchase contracts concluded on the Website are regulated by the Italian law.
The Court of Udine will have exclusive jurisdiction over any dispute related to application, performance and interpretation of this contract, a stated agreement between the parties.
